In developing trial graphics, Empirical Creative adheres to four core principles:

  • Education before argument.
  • Graphics should complement the message, not replace it.
  • Graphics technology should be used with purpose, not for "bells and whistles."
  • Visually, less is more.

Collaborating with our clients to develop trial graphics generally involves a five step process:

  • Concept Identification. The first step in the process involves identifying – either through initial Focus Group testing or in consultation with our clients – the key concepts in the case that will benefit from graphics.
  • Media Format Choice. Given the way today’s jurors process information on a daily basis from multimedia-rich cable television and the internet, trial graphics can, and often should, take on a variety of media forms: 2D or 3D animations, multimedia presentations or trial boards. Ultimately, choosing which media form to use depends on the task at hand.
  • Source Material Collection. All of the relevant primary source material – key documents, testimony, video, etc. – that will be incorporated into the demonstratives are collected.
  • Design Development. Consultants and Designers begin graphics development.
  • Presentation, Client Collaboration & Revise. First drafts of the graphics will be presented to our clients for their feedback. These sessions are designed to be interactive and result in an agreed upon list of revisions which go back into development.
